Terms and Conditions of Use
Discover the regulatory framework governing our online banking, payment and financing solutions in Europe.
1. Purpose of Online Banking & Financing Services
These Terms and Conditions of Use (T&Cs) are intended to govern access and conditions of use of the Flucredit digital portal. They comprehensively regulate all digital banking services made available to you, including viewing deposit accounts, executing payment transactions, using debit cards, as well as access to online loan simulations and subscription tools. Any use of the site implies full acceptance of these terms.
2. Acceptance & Binding Force of the Terms
Browsing our platform and accessing our banking and financial services implies express, informed and unreserved acceptance of these T&Cs by the user. If you disagree with all or part of these provisions, please immediately cease using Flucredit services.
3. Eligibility, Establishment of Relationship & KYC
Opening a current account or accessing secure banking areas is reserved for natural or legal persons fully capable of exercising rights. In accordance with regulatory provisions of the ACPR (French Prudential Supervision and Resolution Authority) and strict anti-money laundering and counter-terrorist financing (AML/CFT) requirements, any commencement of a business relationship is subject to a full identity verification procedure (KYC - Know Your Customer) and verification of the origin of funds.
4. Client Portal Security & Strong Authentication (PSD2)
The security of your assets and financial data is our absolute priority. Access to your secure personal area ('Dashboard') is via confidential personal credentials and a strong authentication mechanism, in strict compliance with the European Payment Services Directive (PSD2). The user is solely responsible for safeguarding their credentials and is liable for any use made of them.
5. Credit Operations, Simulations & Online Loans
Flucredit provides high-performance mortgage, consumer credit and debt consolidation simulators for information purposes only. Results from these simulations are not contractually binding and do not constitute a firm financing agreement. Any granting of credit remains subject to thorough assessment of your creditworthiness by our credit committee after analysis of the supporting documents provided.
A loan is a binding commitment and must be repaid. Check your repayment capacity before committing.
6. Operation of Deposit Accounts & Payment Instruments
Holders of a Flucredit current account have access to a range of payment instruments, including issuance and receipt of SEPA transfers and use of international payment cards. The user is legally obliged to maintain sufficient and available funds in their deposit account before initiating any transaction. Settlement of payment orders is executed in accordance with applicable European regulations.
7. Institution's Liability & Service Continuity
Flucredit implements cutting-edge technologies to ensure the security and continuous availability of its online portal 24 hours a day, 7 days a week. Nevertheless, the institution cannot be held liable for temporary service interruptions due to technical maintenance, software upgrades or failures beyond its control affecting telecommunications networks.
8. Banking Secrecy, GDPR & Data Encryption
Pursuant to Article L. 511-33 of the French Monetary and Financial Code, all Flucredit personnel are bound by the strictest banking and professional secrecy. All your personal and banking data is encrypted according to military-grade security standards (AES-256 encryption) and is processed in strict compliance with the General Data Protection Regulation (GDPR) and our Privacy Policy.
9. Intellectual Property
The entire website, mobile applications, the institution's trademarks, logos, credit simulator infographics and any other graphic or textual element present on the digital portal remain the exclusive property of Flucredit. Any unauthorised use, reproduction, modification or distribution is strictly prohibited and liable to legal sanctions.
10. Complaints, Mediation & Competent Jurisdiction
For any dispute or complaint, the user must first contact our dedicated service at email address contact@flucredit.com. Failing an amicable resolution, the user has the right to refer free of charge to the independent Banking Ombudsman affiliated with the French Banking Federation. These Terms and Conditions of Use are governed by French law and subject to the exclusive jurisdiction of the courts within the appeal jurisdiction of Nice.
